Submission to the Australian Human Rights Commission (AHRC) Thematic Consultation on LGBTIQA+ People in Detention
Our submission to the Australian Human Rights Commission on LGBTIQA+ people in detention calls for revision of the Human Rights Standards for Immigration Detention, which lack enforceable LGBTIQA+ protections. Drawing on research by Dr Paul Simpson (UNSW) and international benchmarks including the Yogyakarta Principles and UNHCR guidance, we recommend placement based on individual risk assessment and the detainee’s informed preference, continuity of gender-affirming healthcare including HRT, PrEP and PEP, an end to solitary confinement as “protection”, and staff training co-designed with LGBTIQA+ communities.
